Terms of Service

1. Service Description

HACCP Hyve provides a food safety training and certification platform. Companies subscribe to provide HACCP training, testing, and compliance tracking for their employees.

2. Accounts

• Company accounts are created during onboarding. The Company Admin is responsible for managing users and subscriptions.
• Employee accounts are created via invitation by the Company Admin or Department Head.
• You are responsible for maintaining the confidentiality of your account credentials.

3. Subscriptions & Billing

• Subscriptions are billed per location on a monthly or annual basis. Your credit card is charged automatically at the start of each billing cycle.
• All plans include a 30-day free trial. No credit card is required to start.
• Prices are shown in your local currency, euros (EUR) or Japanese yen (JPY), and applicable taxes such as EU VAT or Japanese consumption tax are added where required. During the beta the service is provided free of charge and no billing takes place. Full invoicing, including Japanese qualified invoices, will be in place before any paid launch.
• You may cancel your subscription at any time via Settings → Cancel Subscription. Cancellation takes effect at the end of your current billing period, you retain full access until then. No partial refunds are issued for unused time within a billing period.
• We reserve the right to modify pricing with 30 days' notice.

4. Certificates

• Certificates are issued upon successful completion of HACCP training requirements.
• Each plan includes a number of certificates. Additional certificates can be purchased.
• Certificates are valid for the retest period set by the Company Admin (6 or 12 months by default).

5. Acceptable Use

• You may not share accounts or allow unauthorized users to access the platform.
• You may not attempt to circumvent test security measures or manipulate training records.
• You may not use the service for any purpose other than legitimate food safety training and compliance.

6. Data & Privacy

Your use of HACCP Hyve is also governed by our Privacy Policy. Company Admins and Managers can view employee training data within their organization.

7. Intellectual Property

All training content, exam questions, illustrations, and platform software are the intellectual property of HACCP Hyve. You may not reproduce, distribute, or modify this content without written permission.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. Enterprise customers receive SLA guarantees as specified in their agreement.

9. Limitation of Liability

HACCP Hyve provides training tools to support food safety compliance. We are not liable for regulatory non-compliance, failed inspections, or food safety incidents. Compliance with food safety regulations remains the responsibility of the business operator.

10. Termination

We may suspend or terminate accounts that violate these Terms. After termination you may request an export or deletion of your data, and we will delete it within 30 days of your request, unless we are required to retain it by law. Certificates and related compliance records may be kept for the period stated in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the European Union and the Netherlands. Any disputes will be resolved in the courts of Amsterdam, the Netherlands.

12. Changes

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance. We will notify you of material changes via email.
